Creative Parties Limited (referred to as "we", "our" and "us" in these terms) suggest that the customer (referred to as "you" and "your" in these terms) should spend some time in reading through these terms of trading. These Terms and Conditions shall apply above all other unless written deviation is granted.

 

 

We want you to feel confident in accepting the Goods we offer. If you have any questions or queries relating to any of these terms, please feel free to contact us before you enter into the contract.

 

 

 

1.0 Formation of Contract

1.1 Electronic Download

The sale constitutes an agreement binding on both parties. When the order and payment have been authorised you will be sent by email a unique link to allow access to your download page. This period of access is limited to 72 hours from authorisation.

 

Please note that the downloadable games are provided as a service. As such if you agree to the service starting withing your seven day cancellation period, as required under the Consumer Protection (Distance Selling) Regulations 2000, you will loose your right to cancel the contract. By downloading the game you accept this loss of right to cancel.

 

 

1.2 Mail order

As 1.1 above, the payment and authorisation will be by electronic transaction, however instead of getting access to the download page you will be sent the boxed item via 1st Class post, this will be despatched within 7 days from notification of authorisation.

 

 

1.3 Discretion

All orders are dependant of reliance of these terms and conditions, if these cannot be accepted then it will be at the management’s discretion to enter into a binding contract.

 

 

2. Payment terms

Payment will be in the form of an electronic transaction, this is a secure transaction through “World Pay”, once the payment is accepted, notification will be sent to both parties.

 

 

3. Prices

All prices are fixed and firm at the time of the contract. All prices may be subject to local tax at the rate currently in force at the time of this contract. Payment will be in either U$D, euro or GBP.

 

 

4. Intellectual property rights.

When the payment has been made you will be granted a right to use the goods in the manner which they were designed. If you have purchased a game then you will purchase the right to play the game accordingly. This right is personal to the purchaser only and does not allow for public or commercial venture without permission of Creative Parties.

 

 

4.1 Right of purchase

There is also no right of the purchaser to use the games for Charity either by way of sale of by way of playing the game for fund raising, should this however be a requirement then permission must be sought from Creative Parties Limited.

 

 

4.2 Copyright

Creative Parties retain all copyrights in the games and these rights will be defended accordingly. No changes must be made to the games unless by Creative Parties Limited.

 

 

 

On purchasing you undertake to use the goods, including the game responsibly and in accordance with all international and local laws. We do not accept and claim or liability howsoever caused arising from any such breach.

 

 

5.1 Entertainment

The games sold are for entertainment purposes only; these are in no way to be taken seriously. The games by their nature are violent and allow for certain characters of the games to be brutally killed. We do not condone the use of any violence to play these games and as such we do not accept any liability for injury that may follow from your own actions.

 

 

6. Amendments

We reserve the right to revise these Terms and Conditions at any time without notice, we also reserve the right to modify, suspend or change any or all of the services offered without notice.

 

 

7. Unforeseen circumstances

Should you be unable to download the games for any reason we would ask you to inform us as soon as possible by either email, phone or post as listed on the web site, we will undertake to rectify this within 14 days, however if this is going to be a problem please contact us for quicker rectification.

 

Our liability howsoever caused shall be limited to the net contract value only.

 

 

9. Cancellation Policy

You have the right to cancel any order you place with Creative Parties Limited within seven days of receipt of your order. A full refund for the goods will be given if the goods have not yet been despatched. If the goods have been despatched you may return the items to us. However, you will be responsible for the cost of returning the goods.

 

However, please note that the downloadable games are provided as a service. As such if you agree to the service starting withing your seven day cancellation period, as required under the Consumer Protection (Distance Selling) Regulations 2000, you will lose your right to cancel the contract. By downloading the game you accept this loss of right to cancel.

 

9.1 If you opt for our Create a Mystery service then all sales are final as this game is written specifically for you. Our lead time is 4 weeks, but may be longer at busy times. The game will be delivered either as a boxed game or electronically prior to your party. If you would like to use our online party management system then please advise at time of order. Our bespoke service can not be cancelled once writing of the game has commenced.

 
10. Returns Policy

We are sure that you will be happy with the products that you purchase from Creative Parties Ltd. However, in the unlikely event that you are unsatisfied with your purchase we will give you a refund minus postage and packaging when the goods are received back to our warehouse within 7 working daysof receipt. Please contact us for a returns number and enclose within a letter outlining the reason for return. You must take care of our goods whilst in your possession. Any items for return must be received back in its original shipped condition and original packing as you would wish to receive it. The item must be without damage or use and in suitable condition for resale. It must also be odour free - including the smell of smoke, perfume and household smells.

 

Late Delivery -  If the order arrives late for your event we will accept the item back within seven days of receipt. If the delivery arrives late due to you choosing the incorrect delivery method e.g opting for standard delivery when an item is required quickly or you were absent when delivery was attempted a 25% handling charge will be applied.

 

If items are collected from our showroom then a credit note will be issued on any returns. 

 

We cannot accept items for refund, exchange or credit note if you do not comply to these terms.

 

Due to false promises in the past we are unable to replace or exchange an item until the original is returned to Creative Parties. If you need an item quickly you may pay for the new item and a refund will be given once the original is returned.

 

The following products are exempt from our returns policy unless they are faulty.

 

Downloadable games: All sales are final

 

Bespoke Games: No refund will be given once work has commenced on a customised game.

 

Wigs, facial hair, eyelashes, underwear, hats and head dresses, masks hosiery and make up and costume packs that include these: For reasons of hygiene these products will only be refunded if faulty.

 

If a product is found to be faulty then please return the item complete with packaging and a letter stating the fault within 7 working days.

 

By entering into a transaction with Creative Parties Ltd you give permission to agree to our terms and conditions
